Legal Issues in the Artworld for 2022 - ALANA KUSHNIR

We are starting the year off with a lecture on key legal issues facing the art world in 2022. 

In 2022 a number of legal issues are likely to affect the artworld. From copyright infringement and licensing issues affecting the expanding NFT market, to the (mis)classification of arts workers as contractors rather than employees, and the lack of clarity around crediting of collaborators on joint projects. In this session, Alana Kushnir, Director of the art law and advisory firm Guest Work Agency and the Principal Investigator of the Serpentine Legal Lab, will discuss some of the most pertinent legal issues which are currently arising, and share her tips on how to better equip your art practice for 2022.

We will learn about copyright, image/media rights, moral rights, authorship, intellectual property, contracts, universal trading regimes, among other things.

About Alana Kushnir

Alana Kushnir is an art lawyer, advisor and curator based in Melbourne, Australia. Everything she does is at the intersection of art, curating, law and technology.

Alana is the Founder and Director of Guest Work Agency, the first dedicated art law and advisory firm in Australia, and the Guest Club, a subscription-based membership network for art lovers and collectors.

Alana works with a variety of individuals and organisations in the art field, including artists, curators, collectors, galleries, museums, art fairs and art tech start ups, in Australia and internationally. Her legal and commercial advisory work spans a wide spectrum of expertise, including helping clients protect their creative output, diversify their income streams, negotiate multi-party public commission projects, and launch art tech platforms and marketplaces.

Alana is also the Principal Investigator of the Serpentine Galleries R&D Platform Legal Lab, which investigates legal issues and prototypes accessible legal solutions for the art tech field, and a member of the NFT Licensing Taskforce organised by COALA Global, which is developing semi-public licenses for NFTs. She is also a Board Director of the Australian Centre for Contemporary Art (ACCA) and a member of the Art, Cultural Institutions and Heritage Law Committee of the International Bar Association.
